Guidelines and legal determinations of the National Council of Education and the Ministry of Education: a look at higher education in Brazil in the Covid-19 Pandemic

Assuming that it is important to study the impacts that the coronavirus pandemic has brought to education in general, but specifically to higher education, this article presents a mapping and analysis of legal provisions regarding higher education during the COVID-19 pandemic. To achieve the objective, this research is linked to a discussion of teaching knowledge constitution, namely, the teaching knowledge of higher education teachers (TARDIF, 2002, 2010, 2012), highlighting the particularities of their performance (CORDEIRO, 2017; SOUZA, 2020), especially in a context that demands new methodologies (CASTELLAR, 2016), and which distinguishes changes in teaching work (GEMELLI; CERDEIRA, 2020). As a theoretical-methodological path, the research is articulated with a qualitative perspective (LÜDKE; ANDRÉ, 1986), having analyzed the legal determinations published in 2020 and in the first semester of 2021 based on Content Analysis (BARDIN, 2004). According to the results, we identified in the legal determinations the concern with the continuity of activities carried out by the institutions, without discussing the issue of social inequality that impeded the access of some population groups to remote educational processes.
